Manchester City Found Guilty of Premier League Financial Rule Breaches as Club Prepares Appeal

Manchester City’s long-running financial dispute with the Premier League has reached another significant stage after an independent commission found the club guilty of serious breaches of the competition’s financial regulations.

The case, which has been hanging over the reigning English football giants for several years, concerns alleged breaches covering the period between the 2009-10 and 2017-18 seasons.

Manchester City has consistently denied wrongdoing and has now indicated that it intends to appeal the commission’s findings.

The Premier League had originally brought 115 charges against the club. According to the findings outlined by the League, Manchester City was found guilty of the overwhelming majority of the allegations, including matters relating to financial reporting and the club’s obligations to cooperate with the Premier League’s investigations.

What are the charges about?

At the centre of the case are Premier League rules requiring clubs to provide accurate and transparent financial information.The regulations require member clubs to submit financial statements and other relevant information that provide a true and fair picture of their financial position.

This includes information concerning revenues, operating costs, sponsorship income and transactions involving related parties.

The case also concerns the requirement for clubs to act in good faith and cooperate fully with Premier League investigations, including responding to requests for documents and other information.

The Premier League alleges that Manchester City used a series of what it described as “sham contracts” with commercial partners as part of a scheme to disguise more than £830 million in funding.

According to the League, the arrangements allegedly helped artificially increase the club’s reported revenues while reducing its recorded costs.

The allegations are therefore not simply about individual sponsorship agreements. They go to the broader question of whether the financial information presented to the Premier League accurately reflected the club’s underlying financial position during the relevant period.

The independent commission also considered allegations concerning UEFA Club Licensing and Financial Fair Play requirements, as well as Manchester City’s alleged failure to provide information and cooperate with the Premier League over the course of its investigation.

The Premier League’s disciplinary framework allows an independent commission to impose a range of sanctions where breaches are established, including financial penalties, sporting sanctions and points deductions. Any eventual consequences, however, are separate from the commission’s findings themselves and depend on the applicable disciplinary process.

Manchester City Reject the Findings

Despite the commission’s decision, Manchester City has maintained that it is innocent of the accusations and has signalled its intention to challenge the ruling.

In a statement, the club said:

“Manchester City FC is both disappointed and surprised by the opinion of the Premier League Commission, that has been published today.

The Club is innocent of the accusations made by the Premier League and a comprehensive body of irrefutable evidence exists in support of all of its positions, relating to this case.

The Club will therefore be relentless, and where necessary proactive, in any and all appropriate regulatory and legal forums.The Premier League process remains ongoing, with significant elements uncompleted.

Manchester City FC will now pursue the appeal avenues open to it, on the basis that the opinion contains clear material errors, of law, principle and fact, and is unsafe.The Club has diligently respected due process for eight years on the basis that the Premier League Board and Executive would behave as an independent, impartial and fair-minded regulator, free from partisan influence.

The Club is obviously restricted in what it can say further until all future proceedings are complete”.

What happens next?

Manchester City’s next major step is the appeal process. The Premier League’s rules provide a mechanism for a party to challenge an independent commission’s decision, with an independent Appeal Board able to uphold, dismiss or vary a decision.

For now, the case remains unresolved from Manchester City’s perspective. The club continues to dispute the allegations, while the Premier League maintains the findings reached through its independent disciplinary process.

The outcome of the appeal will therefore be crucial in determining what happens next in one of the most significant financial cases in modern Premier League history.
